terms and conditions
Introduction
Thank you for choosing to be a part of our community. Nirvanas Arts Collective CIC is dedicated to helping creatives set up, expand, and build sustainable businesses and develop their creative practices through guidance, resources, and collaborative support.
By purchasing a membership, completing your registration, or accessing our community platforms and digital content library, you agree to be bound by this Agreement. Please read these terms carefully before joining. Please note, some terms and conditions may not apply to your membership tier, however we will clarify the relevance to each membership tier.
Defining terms used:
Terms and Conditions – The paragraphs set out in these terms and conditions are the expectations and obligations of the organisation and the members.
Organisation – This refers to Nirvanas Arts Collective CIC
The Collective – This refers to the group of named disabled and neurodivergent artists that are a part of our memberships. These are the definitions of the memberships.
Creative Space members - This refers to Creative Achiever and Creative Ambitionist tier members.

"Community Membership": The baseline tier focused on resources, community, and mentoring.

"Creative Achiever": The mid-tier level including group coaching, exclusive workshops and 1:1 mentoring.

"Creative Ambitionist": The premium tier including group coaching, exclusive workshops and additional 1:1 mentoring.
Member/s – Members are the individuals that are in the collective.
Third Parties – Refers to anyone, business or group that is not defined and is not directly associated with the Collective, its members or the organisation.
Intellectual Property (IP) – Any original artwork, text, images, or workshop materials created by either the Organisation or the Members.
Our services
The Collective aims to support the ambitions of our members through tiered memberships. The specifics are outline on our membership pages. This is to be used as an overview.
You agree to the specific terms of your chosen tier as outlined below:

Community Member: Includes access to the online content library, social sessions, online community groups, and exclusive access to member-only price paid mentoring.

Creative Achiever: A limited-space membership. Includes live Q&As/group coaching, monthly workshop/talk, mentoring and real world opportunity.

Creative Ambitionist: A limited-space membership. Includes live Q&As/group coaching, monthly workshop/talk, mentoring and real world opportunity.
Newsletter
You will be automatically signed-up to our members newsletter to ensure you are up-dated with the latest events, workshops and opportunities.
Accessibility
We understand the importance of accessibility and aim to embed this into all the services we provide. We work within the Equality Act (2010), and want all members to feel supported within our community. If you have any queries or feedback please message us; we understand the importance of learning and growing in-terms of the accessibility we provide. If you require materials in a alternative format or have specific access needs regarding our digital platforms, please contact us.
Contract terms
All membership tiers are bound by a fixed 12-month commitment period starting from the date of your first payment. By signing up, you commit to completing the full 12-month term and the relevant fees and billing cycles.
Fees and billing

Payment Schedule: For Creative Achiever and Creative Ambitionist tiers, payments are billed monthly for a 12-month fixed term via automatic recurring billing. For Community Memberships, the payment is billed yearly, your first payment will be taken upon signing up and then every 12 months.

Failed Payments: If a monthly or annual payment fails, access to all platforms, content libraries, and mentoring sessions will be suspended immediately until the balance is paid.

Late Fees: If you continue to use our services but payment has failed, we reserve the right to pass outstanding accounts to a debt collection agency if payments are defaulted.

Price Changes and Auto-Renewal: We reserve the right to review and adjust our membership fees annually. We will provide you with at least 30 days' written notice via email of any price changes before your 12-month term expires. If you do not wish to renew your membership at the new price, you can cancel your membership If you do not cancel, your membership will automatically renew for a subsequent 12-month term at the updated rate; the cancellation and cooling off period will apply.
Low-Income Spaces & Renewals: The Creative Space

Availability & Waitlists: Low-income spaces are strictly limited to ensure the financial sustainability of the Organisation. For this reason, we cannot guarantee that a low-income space will be available for you to renew into for a consecutive 12-month term.

The Rotation System: These spaces operate on a waitlist basis. If there are eligible individuals on the waitlist waiting to join when your 12-month term concludes, priority will be given to those who have not yet access-supported their practice through the programme.

The Renewal Process: We will contact you 30 days before your 12-month term ends to discuss your options. If there is no waitlist, you may be permitted to renew your low-income space for another year. If there is a waitlist, we will gladly support your transition to a standard membership tier if your circumstances have changed, or add you to the low-income waitlist for a future cohort.
Cancellation and cooling off period

Statutory Cooling-Off: As your memberships is purchased online, you have a 14-day cooling-off period from your initial purchase date to cancel and receive a full refund, provided you have not accessed our used any services as part of the membership. This also applies to membership renewals. If you have used any services you may be able to receive a partial refund, at the organisations discretion.

Early Cancellation: Because this is a fixed 12-month contract, you cannot cancel your membership early after the 14-day cooling-off period. If you wish to leave the membership before the 12 months expire, you remain legally liable to pay the remaining balance of the 12-month term if your membership is paid monthly.

Notice Period: To prevent your membership from automatically renewing for a subsequent 12-month term, you can cancel your membership before the fixed term lapses, keeping access up until the date your membership would have renewed. You can cancel memberships using your member dashboard. For Creative Achievers and Creative Ambitionists, we will discuss if you would like to continue your membership for another year, however you can also cancel your membership via your member dashboard.
Mentoring sessions
The Creative Space members terms
Expiry of Hours: Mentoring hours must be used within your 12-month term, hours cannot be rolled over into the next membership year. Unused sessions are forfeited. It is the members responsibility to book mentoring.

Cancellation Policy: You must provide at least 24 hours' notice to reschedule a 1-to-1 mentoring session. Sessions cancelled with less than 24 hours' notice or missed entirely ("no-shows"), will be forfeited and count as used.
Community membership terms

Cancellation: If you cancel with less than 48 hours notice, no refunds will be made.

Mentoring Packages: Mentoring packages purchased by Community Members are non-refundable and must be used within 12 months of the package purchase date.

Low income slots: Low-income mentoring slots are offered on a trust basis to those who need financial accessibility. We do not require formal proof of income, but we ask members to respect the integrity of this system.

Price Adjustments: We reserve the right to change our mentoring slot fees, including standard and low-income rates. However, any price changes will not affect current bookings and mentoring packages that have already been paid for. If you are a participant in the Creative Space, your costs are fully locked in and guaranteed not to change for 12 months from your joining date.

Exemptions: We understand that life happens. We reserve the right to be more flexible with our mentoring booking and expiry rules where a member faces extenuating circumstances. However, please note that any flexibility is granted on a case-by-case basis and does not guarantee that the same leniency will be applied in the future.
Workshops and events

Scheduling: Live Q&As, group coaching, socials and workshops are scheduled at our discretion. While we aim to keep times consistent, we reserve the right to change dates/times with reasonable notice. No refunds are given for missed group sessions.

Exhibitions: Creative Achievers and Creative Ambitionists are entitled to enter one exhibition a year with no hanging fees. We do not take any commission on profits from your artwork sales. However, to cover card processing, administrative costs, and financial losses associated with managing transactions, a flat 5% processing fee will be deducted from the total sale price of any artwork sold through the exhibition.

Exhibition date outside of membership term: As we can not guarantee a date the exhibition will be held each year due to availability or factors outside the organisations control, if your membership as a Creative Space member runs out prior to the exhibition date, you will still be eligible to participate and access any relevant planning groups in the lead up. This does not get you access to online groups and socials however, only sessions related to the exhibition.

Guidelines, Liability, and Shipping: Members must comply with all gallery submission guidelines, deadlines, and artwork presentation standards. Nirvanas Arts Collective CIC is not liable for the damage, loss, or theft of artwork during exhibitions or transit, even if we arrange the shipping. In the event of damage or loss during transportation, we will assist you in seeking compensation from the shipping provider. We will never ship artwork without appropriate insurance coverage. All shipping costs will be passed on to the creator. Members are strongly advised to maintain their own independent insurance policies for their artwork.

Artwork Authenticity & IP: You guarantee that all artwork submitted to our exhibitions is your own original creation and does not infringe on the intellectual property rights of any Third Party.

External or Special Events: Certain exhibitions, pop-ups, or events hosted by the organisation may fall outside the scope of these standard membership terms. Whether these events are exclusive to members or open to the general public, they will be governed by their own specific terms and conditions. You will be provided with these standalone terms and must agree to them before participating or getting involved.
Group Session Recordings: The Creative Space

Community members: Online socials and Q+As may be recorded. We may record workshops for members to access again/watch online however members will be made aware of this prior to recording starts. The same terms will apply, access will be limited to community members only, and you have the right to privacy and opt-out requests.

Purpose of Recordings: To ensure this programme is accessible and accommodating, all live group coaching, Q&A sessions and workshops/talks are recorded. These recordings allow members to catch up if they miss a session, revisit complex topics at their own pace, or watch without the pressure of live participation.

Internal Access Only: Recordings will be hosted in The Creative Space online group. Depending on the content, some sessions will be deleted within a specific timeframe, others will become permanent in our closed online group, which will only be available to The Creative space members.

Q+As: If a Q+A and group coaching session or social is recorded, it will be deleted within 90 days from the upload date.

Workshops: If a Workshop it recorded, it will be kept live in the closed group for current and future members to access. The deletion date is indefinite. This allows current and future members to access previous workshops and masterclasses.

No External Sharing: Members are strictly prohibited from downloading, screen-recording, sharing, or publishing any part of the group recordings outside the membership platform.

Respecting Peers: Any personal stories, business details, or vulnerabilities shared by other members during a recorded session must remain entirely confidential.

Privacy & Participation Choices: We want you to feel safe and comfortable showing up exactly as you are. You have complete control over how you appear in these recordings:
Camera & Microphone: You are never forced to turn on your camera or microphone. You are welcome to participate via the chat box or simply listen passively.
Display Names: You may change your display name on zoom/the video platform to a pseudonym or your initials if you do not want your full name visible in the recording.
Chat Transcripts: Chat logs are saved only for the purpose of sharing links or resources mentioned during the session. Private direct messages sent between members are never recorded.

Implied Consent: By joining the live group sessions and speaking or turning on your video, you consent to your voice, image, and chat contributions being included in the cohort recording.

Ownership: All session recordings remain the intellectual property of the organisation. They are provided solely as a learning resource for your 12-month membership period.

Opt-Out & Deletion Requests: If you accidentally share something highly sensitive during a live call and feel uncomfortable with it being in the replay, you can contact us within 24 hours of the session. We will happily edit out that specific segment before uploading the recording to the member area.
Online Artist Directory

Purpose of the Directory: The Online Artist Directory is a public-facing showcase designed to give your creative business visibility. It serves as a tool for galleries, curators, buyers, and funding bodies to discover your work and contact you directly. It is available to current and past creative achiever and creative ambitionist members.

Your Intellectual Property: You retain full copyright and ownership of all artwork images, text, and bios you create for us to your directory profile.

License to Display: By submitting content to the directory, you grant us permission to display your images and text on our website and across our promotional channels (like social media and newsletters) to celebrate your work and promote the directory.

Content Accuracy: You are responsible for ensuring your profile details are accurate and that you own the rights to all images submitted.

Direct Communication: The directory allows the public to contact you. We are not responsible for, and cannot control, the nature of external enquiries, commissions, or sales requests you receive through these links. You are fully entitled to set your own boundaries regarding how and when you respond to public enquiries. You are never obligated to accept work or reply to messages that cross your personal or professional boundaries. If you receive inappropriate, abusive, or harassing messages via a contact link on our directory, please report it to us immediately and we will support you to take action.

Graduation Perk: To support your long-term sustainability, your profile will remain live and active in our directory indefinitely after your formal mentoring programme ends, free of charge.

Profile Removal: You have the right to request the complete removal of your profile, or changes to your contact information, at any time during or after the programme. We will process removal requests within 7 business days.

Content Restrictions: To maintain a safe and accessible environment for all members and visitors, your directory profile must not contain:

Explicitly graphic violence or hate speech.

Contact information or links that lead to unsafe or fraudulent websites.
-
Defamatory statements about other artists or organizations.
Community conduct

Community Safety: Because our members share personal and business vulnerabilities, you agree to keep all information shared by other members within group sessions strictly confidential. Nirvanas Arts Collective CIC reserves the right to terminate any membership immediately, without a refund, if a member breaches this code of conduct.

Celebrating our Members: Our differences are a celebration not a hindrance and the collective aims to represent the diversity of creative voices and artists. We understand we all have different views and perspectives however any views that limit the rights of others, will not be tolerated.

Inclusion: Our members represent us as an organisation and therefore we expect our members to foster a community of kindness and respect. Our diversity and Inclusion statement can be viewed here: DEI Statement. Any member who has been found to be involved in Hate speech, bullying or discrimination unfortunately will no longer be allowed to be a part of the Collective and membership will be cancelled with immediate effect. This is to foster a supportive and welcoming environment.

AI art: We do not allow any sharing or creating of AI art. It is our stance that AI hurts artists, including disabled and neurodivergent creatives. AI uses images taken from real artists and makes a generated image from this work. Until the necessary safeguards are put into place to protect artists from AI stealing their work and the environmental impact has been considered, we will not accept AI art into the group.
Intellectual property

Our content: All resources, videos, frameworks, templates, and materials in the online content library are the intellectual property of Nirvanas Arts Collective CIC. They are for your personal business use only and cannot be shared, resold, or redistributed. We kindly ask that you do not share resources exclusive to our memberships. If you are found to be redistributing our content, we hold the right to cancel your membership with immediate effect, and no refunds will be given.

Your Content: You retain all intellectual property rights to the creative work you produce, discuss in mentoring, or display in exhibitions.
Disputes
Disputes can occur at any time between members and/or between member/s and the organisation. We aim to resolve any disputes informally by ensuring member/s feel involved and satisfactory with the outcome.
If a resolution cannot be found in the first instance, we have an outlined complaints procedure. The procedure and contact details for handling complaints can be requested.
Limitations of liability
10. Limitation of Liability
We provide business guidance, resources, and mentoring in good faith. However, we do not guarantee specific financial returns, business growth, or success metrics. You accept full responsibility for your business decisions and outcomes.
Whilst the terms and conditions aim to be comprehensive, there are scenarios, obligations and agreements that fall outside the scope of these terms and conditions.
All alternative agreements between the organisation and our member/s will create a new set of terms that may have a limited timeframe or be ongoing; the timeframe will be outlined in the terms. These new terms will be in writing for both the organisation and the member/s to refer to. An example of new terms and conditions may be an exhibition where the costs, commission and other terms may differ for those participating in that particular event.
Governing laws
This Agreement is governed by and construed in accordance with the laws of [England and Wales / Scotland / Northern Ireland].
